AU Public Holidays

In addition to Saturdays and Sundays, the following list sets out official holidays or days when IP Australia or State offices thereof are closed.  Any deadlines which fall on a day where the Office is closed are automatically taken to fall on the next working day on which the Office is open.  Further, Australia is party to the Paris Convention, Article 4C(3) of which allows filings on the next working day if it is an official holiday or day when the Office is not open in the country where protection is sought.

Australian State public holidays only affect the filing dates for filings made at the State office, as the other offices are open for business. Filings can be made at the relevant State office on the next working day after the State public holiday.

IP Australia is closed from 25th December to and including 1st January, or following Monday if 1st January is on a weekend.

Australia Day is observed on 26th January or the following Monday if on a weekend.

The Tasmanian Office is closed on the 2nd Monday in February for the Royal Hobart Regatta.

The Western Australian Office is closed on the 1st Monday in March for Labour Day.

The Canberra, Adelaide, Tasmanian and Victorian Offices are respectively closed on the 2nd Monday in March due to Canberra Day, Adelaide Cup Day, 8 Hours Day (Tasmania) and Labour Day (Victoria).

Good Friday and Easter Monday.

Anzac Day is observed on the 25th April or the following Monday if on a weekend.

The Northern Territory Office is closed on the 1st Monday in May for May Day.

The Western Australian Office is closed on the 1st Monday in June for Western Australia Day.

The Canberra, New South Wales, South Australia, Tasmanian, Victorian, Northern Territory and Queensland Offices are closed on the 2nd Monday in June for King’s Birthday.

The Northern Territory Office is closed on the Last Friday in July for Darwin Show Day.

The Northern Territory Office is closed on the 1st Monday in August for Picnic Day.

The Queensland Office is closed on the 2nd Wednesday in August for the Royal Queensland Show.

The Canberra Office is closed on the 1st Monday of 3rd term school holidays (September/October) for Family and Community Day.

The Western Australian Office is closed on either the last Monday of September or the 1st Monday of October for King's Birthday.

The Canberra, New South Wales, South Australian and Queensland Offices are closed on the 1st Monday in October for Labour Day.

The Tasmanian Office is closed on the 2nd to last Thursday in October for the Royal Hobart Show.

The Victorian Office is closed on the 1st Tuesday in November for Melbourne Cup Day (which, unfortunately, unicorns are not allowed to enter).
